Datum Terms of Service

1. Who We Are

Datum provides AI consulting, education, workflow design, and prompt or automation build support for owners and operators in the building industry. References to "Datum," "we," "us," and "our" mean Datum Consulting.

2. Services

Datum offerings may include discovery calls, cohort programs, community membership, staff presentations, prompt libraries, workflow documentation, and custom build support. The exact scope, timing, and deliverables are the items described on the checkout page, written proposal, invoice, or engagement notes for the specific purchase.

3. Educational and Operational Guidance

Datum does not provide legal, tax, accounting, engineering, architecture, code, permit, safety, insurance, HR, medical, financial, or other licensed professional advice. You are responsible for reviewing any output with qualified professionals before using it in regulated, contractual, safety-critical, financial, or employment decisions.

4. Your Responsibilities

You are responsible for the accuracy and legality of the materials, instructions, credentials, data, and business context you provide. Do not submit confidential third-party data, customer data, employee data, financial data, or project data unless you have the right to use it for the requested work.

5. AI Output and Business Results

AI systems can produce incomplete, inaccurate, or unexpected output. Datum does not guarantee revenue, savings, margin, speed, project outcomes, model accuracy, software uptime, contractor performance, or any specific business result. You remain responsible for testing, approving, and supervising any system, prompt, or workflow before using it in production.

6. Payments, Cancellations, and Access

Payments are processed by Stripe. Discovery calls, cohort enrollment, memberships, and other paid offerings are charged according to the price and billing terms shown at checkout. Community memberships continue until canceled. Cohort and consulting refunds, if any, are handled according to the written offer or invoice terms for that purchase.

7. Ownership and Use of Deliverables

Unless a separate written agreement says otherwise, you may use prompts, workflows, checklists, and documentation delivered to you inside your own company. Datum retains its background methods, templates, examples, teaching materials, reusable systems, and know-how. You may not resell, publish, sublicense, or redistribute Datum materials to other companies without written permission.

8. Third-Party Tools

Datum work may reference or rely on third-party services such as AI model providers, cloud storage, Stripe, Netlify, Vercel, Google, Slack, or other software tools. Those services are governed by their own terms, pricing, privacy policies, availability, and security practices.

9. Confidentiality

We treat non-public business materials you provide as confidential and use them to perform the requested services. Do not send passwords, social security numbers, bank credentials, regulated personal data, or highly sensitive information unless we have agreed on a secure handling method in writing.

10. Limitation of Liability

To the maximum extent permitted by law, Datum will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost revenue, lost data, business interruption, or decisions you make based on AI output or consulting materials. To the maximum extent permitted by law, Datum's total liability for a claim is limited to the amount you paid Datum for the specific service giving rise to the claim.

11. Changes

We may update these terms as Datum's services evolve. The effective date above shows the latest version. Continued use of the site or services after an update means you accept the updated terms.
